GENERAL AGREEMENT:

The mare owner agrees to breed the designated mare to the servicing stallion by the chosen breeding method during the 2008 breeding season. A copy of the mare’s registration papers, verification from a licensed veterinarian that the mare is free from infection (negative uterine culture) and a current negative Coggins test should accompany this contract as well as a 50% deposit of $250.00. The remainder of the breeding fee or a letter from a licensed veterinarian stating that the mare is not pregnant, in lieu of payment, is due within 30 days.

ON PREMISES BREEDING:

• All mares must arrive at Stalder’s Irish Gate Farm sound to breed and halter broken.
• The mare owner agrees to pay all veterinary fees as they occur.
• A daily board charge of $5.00 shall be assessed.

GUARANTEES:

Live Foal:

The stallion owner guarantees a live foal. Live foal is defined as a foal that stands and nurses without assistance. If the mare aborts the foal, the foal dies within 24 hours of birth or the mare dies during pregnancy/birth, the mare owner is entitled to one rebreed. The rebreed is for the same mare or a mutually agreed upon substitute mare to the same stallion and must be used the following contract year.

PAYMENT:

Payment past due thirty days will be considered in default and the stallion owner is entitled to exercise all legal remedies available to collect the amount due at the mare owner’s expense. A service charge of 2% interest will be assessed monthly, until payment is received in full.

The mare owner’s signature attests to the fact that the owner has read and understands all of the outlined herein and accepts this contract as a legal and binding instrument in the state of Kansas. This contract cannot be assigned or transferred.

Under Kansas law, a farm animal activity sponsor, farm animal professional or other person does not have the duty to eliminate risk of injury due to participation in farm animal activities. There are inherent risks of injury that you voluntarily accept if you participate in farm animal activities.
